Terms of Service

These Terms govern use of the Profundo AI service at profundoai.com and its customer API. “Profundo AI,” “we,” and “us” refer to the operator of that service. These Terms describe a launch-period membership service and do not claim legal review is complete.

Eligibility and agreement

You must be at least 18 years old, able to enter a binding agreement, and use the service only for yourself or an organization you are authorized to represent. By creating an account or using the service, you agree to these Terms and the Privacy Notice.

Access

Access may be opened or closed, and operational capacity may be managed, at our discretion. Creating or verifying an account, joining the waitlist, or receiving an invitation does not guarantee admission, checkout, API access, founding pricing, or continued access. No customer pays while waiting for admission.

Founding membership offer

Founder is available during the launch/founding period at $20 per month while continuously subscribed. A waitlist request, verified account, invitation, or admission without verified payment does not consume or reserve founder eligibility.

If a founding member cancels, stops paying, receives a refund or chargeback, is terminated, or otherwise ends continuous membership, they lose founder pricing. The historical allocation is permanent and is not reused; a later rejoin uses the then-current published offer.

The published tiers and pricing as of August 7, 2026 are: Founder $20/month during the launch/founding period, truly unlimited requests; Plus $10/month ($5 first month) with a 250 request/day ceiling; Priority $20 for the first month then $40/month, with a 2,000 requests/day cap that may be raised as demand grows; Performance $50 for the first month then $100/month, unlimited requests. Yearly billing on every plan is 10% off, billed annually. No live checkout or renewal configuration is claimed until activated on each user's account.

Request limits and fair use

The membership is not priced per token. Plus includes 250 requests per day. Priority includes 2,000 requests per day; we may raise this cap as demand grows. Founder and Performance are truly unlimited. Use is subject to abuse prevention, safety, and service protection controls. No throughput, uptime, concurrency, or model guarantee is offered.

Model availability

The model catalog changes over time. Models may incur outages at any time, and models may be added, removed, replaced, or have their behavior or availability changed at our sole discretion, with or without notice. Deprecated models may stop working on short notice and are not guaranteed to remain accessible after removal. No model, feature, or capability is part of a promise of continued availability.

Billing, cancellation, and refunds

Paid access is available only after admission and verified payment. You are billed in advance on a monthly or yearly basis depending on the plan you select. You can cancel at any time through the Stripe customer portal; cancellation stops renewal at the end of your current billing period. No partial or prorated refund is provided for unused time within a billing period after the refund window closes.

Refund policy. If you are not satisfied with the service, you may request a full refund of your initial purchase within 24 hours of that purchase. After the 24-hour window, the purchase is final and no refund is available for that billing period. To request a refund, open a billing support case from your dashboard support page or email the address listed on our support page with your account email and the reason for your request.

Chargebacks. Before initiating a chargeback or payment dispute with your bank or card issuer, you must first open a billing support case through the dashboard support page or by emailing the address on our support page. This gives us the opportunity to investigate and resolve your concern directly. Initiating a chargeback without first submitting a billing support case is a violation of these Terms and may result in account suspension. We reserve the right to submit evidence of the support case requirement and service delivery records to dispute any chargeback filed without prior contact.

Your account and API keys

Provide accurate account information and protect your password, session, and API keys. You are responsible for activity under your credentials. Do not share keys publicly, resell or share access, or embed keys in client-side applications. Rotate a key you believe is lost or exposed.

Acceptable use

Do not engage in automated bulk abuse, resale or sharing of credentials, evasion of controls, service disruption, unlawful use, fraud, malware distribution, rights violations, or processing data you lack authority to use. Temporary restriction or suspension may be applied for private review and possible restoration. No restoration time or outcome is promised.

Intellectual property

We retain rights in the service, site, software, documentation, and branding. You retain rights you hold in content you submit. You give us the limited permission needed to process submitted content to operate, secure, and support the service. These Terms do not grant rights to third-party material in inputs or outputs.

Service changes and termination

You may stop using the service at any time. We may restrict, suspend, or terminate access to protect the service or others, address suspected misuse, comply with law, or discontinue service. Features, models, limits, compatibility, and availability may change or stop.

No warranty

To the extent permitted by law, the service is provided “as is” and “as available,” without warranties of accuracy, fitness, non-infringement, availability, or uninterrupted operation. Outputs can be incomplete, inaccurate, or unsuitable and must be evaluated before use. Nothing excludes a warranty that cannot lawfully be excluded.

Limits of responsibility

To the extent permitted by law, Profundo AI is not responsible for indirect, incidental, special, consequential, or lost-profit damages arising from the service. Nothing limits liability that cannot lawfully be limited.

Privacy

Our Privacy Notice explains high-level data handling. Do not submit sensitive or regulated data unless you have authority and have confirmed the service is appropriate for that use.

Changes to these Terms

We may update these Terms as the service changes. We will post the revised date and provide additional notice when required. If you do not accept an update, stop using the service.

Governing law and disputes

Governing law and dispute venue have not yet been designated. These Terms do not claim a contractual choice of jurisdiction. A completed governing-law and venue term will be published in a future revision.
